Terms of service

These terms govern domain, hosting and VPS services sold by JMSURFHOST, a division of JMSURF TECHNOLOGIES (Kenya).

1. Accounts. You must give accurate details and keep your login secure. You are responsible for everything done under your account.
2. Payment and renewal. Services are prepaid. Renewal invoices are issued before the due date; unpaid services are suspended after the due date and may be terminated and deleted after 14 days. Domain names that are not renewed in time can be lost to the registry.
3. Acceptable use. No illegal content, malware, phishing, spam, copyright infringement, crypto-mining on shared hosting, or attacks on other networks. We may suspend services that put our network or other customers at risk.
4. Domains. Registrations follow the rules of KeNIC and the relevant registries; registrant details must be accurate. Registration fees are not refundable once submitted.
5. Backups. We keep backups as described in each plan, but you remain responsible for your own copies of your data.
6. Software licences. You must hold a valid licence for any software on your server that needs one. Windows servers start on Microsoft's Windows Server evaluation edition, which is for evaluation only and runs for 180 days; to keep using Windows you must activate it with your own Windows Server licence of a type Microsoft allows on a hosting provider's servers, such as a licence with Software Assurance or a subscription licence. The same applies to cPanel, Plesk and other licensed software. We do not supply these licences, and you are responsible for any licence fees or claims that arise from software you run without a valid licence.
7. Refunds. Hosting can be cancelled within 7 days of first purchase for a refund of the hosting fee (domains and VPS setup excluded).
8. Liability. Our liability is limited to the fees paid for the affected service in the previous 3 months.
9. Changes. We may update these terms; the version on our website applies.
